Privacy Policy

Your privacy is important to us at 3D Travel, Inc. , Inc. ("3DT". “we” or “us”) and we have prepared this Privacy Policy to explain to you how we collect, use, and share information we obtain through your use of our websites located at http://www.3dhawaii.com and http://www.3dlasvegas.com, www.3dsanfrancisco.com, www.3dtravel.com, and any of our other websites, email messages, or software containing a link to this Privacy Policy (each, a “Site”), as well as any products or services offered through any Site (collectively, our “Sites and Services”). This Privacy Policy does not govern our use of any information you provide to us when you call us, write to us, or communicate with us in any manner other than through our Sites and Services. Because the Internet is global, information about you that we collect or that you submit may be transferred to, processed in, and held in countries (including the United States) other than the one in which you reside. By using any of our Sites and Services, you explicitly consent to such use of your information and agree to the terms of this Privacy Policy. This Privacy Policy is effective as of June 1, 2010.

1. Information We Collect.

a. Information You Choose To Submit.

(1) PII. You can visit a Site without telling us who you are or revealing any personally-identifiable information about you, such as your first and last name, email address, telephone number, or credit card number (“PII”). If, however, you become a registered user of our Sites and Services or submit a form requesting information from us, you may be required to provide certain PII. For example, our 3d building registration process, 3d listing registration process, and 3d banner advertising program require that you provide us with your first and last name, e-mail address, and telephone number, as well as other personal and business information. We collect any PII or other information you choose to submit through our Sites and Services.

(2) Promotions. From time to time, you may be given the opportunity to participate in sweepstakes, contests, giveaways, or other promotions offered by us, either alone or with promotional partners. Participation in these promotions may require you to submit information about you, including PII. Our use and sharing of your information, including PII, collected through a promotion will be governed by the official rules or agreement governing that promotion, as well as by this Privacy Policy. The terms of those rules or that agreement will control over any conflicting provisions of this Privacy Policy.

b. Information We Automatically Collect.

(1) Cookies. We automatically collect certain information to help us understand how you use our Sites and Services. Our Sites use cookies (which are alphanumeric identifiers that we send from our web server to your browser and are stored on your computer’s hard drive) to enable our systems to recognize your browser. We use persistent, identifying cookies to remember your information and to link your activities to you. Generally, you can set your browser not to accept cookies or to notify you if you are sent a cookie, giving you the opportunity to choose whether or not to accept the cookie. Please note that if you do set your browser not to accept cookies, certain aspects of our Sites and Services may not function properly. Our cookies may collect: (a) the domain name and host from which you access the Internet and the Internet address of the website from which you direct-linked to ours; (b) the date and time you access a Site and pages you visit; (c) your computer's IP address and information about its operating system, platform and the browser type and version you use; (d) demographic information; (e) information to combat fraud or misuse; and (f) other data relating to your usage of our Sites and Services.

(2) Pixel Tags. In our emails to you, we may use "pixel tags" to determine if your email software or service can display html-formatted email. This helps us optimize the size of our email messages and conserve bandwidth.

(3) Collection of Information by Third Parties. Some of the advertisers and other businesses that advertise or display other content on or through our Sites and Services use cookies and may place a cookie on your computer. The content posted by these businesses will be identified as coming from a third party. In addition, we use third-party advertising companies to serve ads. These companies: (a) use information obtained from your use of our Sites and Services and other sites to serve ads to you; and (b) place unique, third-party cookies on your browser. We also may use “web beacons” provided by third-party advertising companies, which enable us to recognize your browser when a cookie has been placed on your computer and help optimize our advertising. Some but not all, third-party advertising companies provide a mechanism to opt-out of their technology. The information collected by third-party cookies is subject to the privacy policy of the third party, not this Privacy Policy.

2. How We Use the Information We Collect.

a. PII. We use your PII to answer your questions, to fulfill your requests for products and services, to improve our Sites and Services, to contact you from time to time about us, our Sites and Services, or other products and services, to enforce our rights and the rights of third parties, and to investigate and ensure compliance with the Terms of Use and other agreements relating to our Sites and Services.

b. Other Information. We use information collected by cookies to keep track of your use of each of our Sites and Services, to validate your identity, to remember your password and preferences, to tailor each of our Sites and Services to meet your personal interests, and to improve the quality of our Sites and Services. We use other non-PII information we collect, including IP addresses, to measure the number of visitors to sections of our Sites and Services, to keep track of your use of each of our Sites and Services, to analyze trends, to gather demographic information, and to improve the quality of our Sites and Services.

3. Our Information Sharing Practices.

a. Generally. Except as otherwise described in this section of our Privacy Policy, we will never share your PII or other data about you that we collect from you through our Sites and Services (collectively, “User Information”) with any third party without your permission.

b. Usage Data. From time to time, we may enter into relationships with third parties to help us collect data relating to your use of our Sites and Services. In those circumstances, those third parties have access to that data and any third party cookies set during such collection of data are governed by the privacy policies of those third parties.

c. Aggregated Data. From time to time, we may share aggregated User Information with third parties. We will not share any aggregated User Information, however, in a manner that would enable the recipient to personally identify you.

d. Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., marketing assistance, customer service, email newsletters, data analysis and management). In those circumstances, we disclose User Information that is necessary for such service providers to perform those services. If you decide that you would no longer like us to send you email newsletters or other email-based correspondence, please follow the instructions as set forth below in “Choice/Opt-Out.”

e. Advertisers and Promotional Partners. We share User Information with advertisers, service providers, and other persons with whom we conduct business. In addition, these advertisers, service providers, and other persons may share with us non-personally identifiable information about you that they have independently developed or acquired. From time to time, we may share your User Information with promotional partners or other third parties so they may contact you regarding goods or services in which you may be interested. If you decide that you would no longer like us to disclose you User Information to third parties for the third parties’ direct marketing purposes, please contact us as noted below in “Choice/Opt-Out.”

f. Affiliates. We may share User Information with our parents, subsidiaries, affiliates, joint ventures, or other related companies (our “Affiliates”). Any use of your information by our Affiliates will be subject to this Privacy Policy or another policy no less protective of your privacy. Conversely, we may obtain User Information from our Affiliates or from your visits to other websites that we or our Affiliates control.

g. Public Information. If you identify any User Information as public, you are authorizing us to share such information publicly. Also, there may be areas of a Site (e.g., reviews, comments, and online forums) in which you are able to post information that will be available to all other users of a Site. By choosing to use these areas, you understand and agree that anyone may access, use, and disclose any information that you post to those areas.

h. Other Disclosure Scenarios. Notwithstanding anything in this Privacy Policy to the contrary, we reserve the right, and you hereby expressly authorize us, to share any User Information: (1) to comply with applicable law, including in response to subpoenas, court orders, or legal process, to address written complaints of copyright infringement; (2) to establish, protect, or exercise our legal rights or defend against legal claims, including to enforce any Terms of Use on our sites or other agreement relating to our Sites and Services; (3) if we believe it is necessary in order to investigate, prevent, or take action regarding suspected illegal activities, fraud, or situations involving potential threats to the safety of any person or property, including our own; (4) if we believe it is necessary to investigate, prevent, or take action regarding significant abuse of any of our Sites and Services or the Internet in general (such as voluminous spamming, denial of service attacks, or attempts to compromise the security of information); (5) if all or any portion of our business is acquired by, acquire, or are merged with another entity, if we undergo a change of control, or if we engage in a similar transaction, in which case we may share User Information with the acquiring, acquired, or successor entity, or its investors, lenders, or advisors; and (6) if we become the subject of bankruptcy proceedings, in which case we may share User Information with a bankruptcy trustee, debtor in possession, or subsequent purchaser of assets.

4. Retention; Modifying and Deleting Your PII. We retain your User Information at our discretion and in accordance with applicable laws. However, we do not undertake any retention obligations, and may dispose of information in our discretion without notice, subject to applicable law that specifically requires the handling or retention of information. You must keep your own, separate back-up records. If you would like to modify or delete from our database any User Information you previously submitted to us, you may email us at support@3dtravel.com. If you are a registered user, you may also update your User Information on your profile page. We may keep a record of all information that is changed or deleted, and we may determine what may be changed or deleted. For example, if we are required to keep track of certain kinds of transactions, you may be prevented from changing or deleting information relevant for those transactions. Please note that any User Information that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information you may not be able to order products or services in the future without re-submitting such information. We are not responsible for removing information about you from the databases of any third parties to whom we were authorized to disclose your information prior to processing a request from you.

5. Choice/Opt-Out. We offer you the opportunity to control whether we may use your PII to send you promotional and marketing messages and whether we may share your information with our promotional partners. You may opt out of such messages or sharing at any time by following the instructions provided in each such message you receive from us. If you are a registered user of any of our Sites and Services, you may also opt out of such messages or sharing by accessing and updating your privacy settings through your profile page. Please note that sometimes these requests may take up to ten (10) business days to process. Even if you do opt out of promotional and marketing messages from us, we reserve the right to send you messages relating to ours Sites and Services (e.g., about changes to this Privacy Policy or our Terms of Use, listing submissions, quotes for building development, or general system and administrative messages) and to contact you regarding any products or services you have ordered.

6. Security. We have implemented reasonable measures to help protect your User Information from loss, misuse, or unauthorized access or disclosure. Unfortunately, however, no data transmission over the Internet (including by email) can be guaranteed to be 100% secure. Neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes, or fail to follow policies. As a result, while we strive to protect your User Information, we cannot guarantee its security. If applicable law imposes any non-disclaimable duty (if any), you agree that the standard used to measure our compliance with that duty will be one of intentional misconduct. If you are concerned about interception of sensitive information, do not include it in any email or other transmissions to us. You must do what you reasonably can to ensure the security of your PII and of our Sites and Services. You should protect against unauthorized access to your computer. For example, please sign off when finished using a shared computer.

7. Links. Our Sites and Services may contain links to other websites. We are not responsible for the privacy practices of any such other website and urge you to review such practices prior to submitting any information to such websites.

8. Children’s Privacy. We are committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children’s online activities and interests. Our Sites and Services are not intended for and may not be used by children (which we consider to be any person under the age of 18 or, if higher, the age of majority in your jurisdiction). We do not knowingly collect information from children and we do not target our Sites and Services to children.

9. Changes. We may modify this Privacy Policy from time to time. If we make any material change to the way in which we treat your User Information, we will inform you of such change via e mail or by posting a notice on relevant areas of a Site. Any modified version of this Privacy Policy will be effective as of the date set forth therein. If you continue to use any Sites and Services after the effective date of a modification, you will be deemed to have agreed to the Privacy Policy as modified.

When we need to contact you, we may do so to an email address that we have on file for you, or we may post notice on a Site. This includes any notices we may be required to send you by law, such as those regarding breach of any security systems. Therefore, it is critical that you keep your email contact information correct and updated with us at all times.
